Acceptance of Terms
By using the services provided by Buckeye Physical Therapy (“we,” “us,” or “our”), including our SMS appointment scheduling system, phone services, and website, you agree to be bound by these Terms of Service. If you do not agree with these terms, please do not use our services.
Description of Services
Buckeye Physical Therapy provides physical therapy services at our clinic in Edinburg, Texas. In addition to in-person care, we offer the following communication and scheduling services:
- SMS Appointment Scheduling: Text-based scheduling to book, reschedule, and cancel physical therapy appointments
- Appointment Reminders: Automated text message reminders sent before your scheduled appointments
- Phone Services: Voice call handling for appointment inquiries and scheduling
- Appointment Confirmations: Text message confirmations for newly scheduled appointments
Consent to Receive Text Messages
By texting our business phone number (956-476-5310) or providing your phone number for appointment scheduling, you consent to receive text messages from Buckeye Physical Therapy related to:
- Appointment scheduling and confirmations
- Appointment reminders (typically 24 hours and 2 hours before your appointment)
- Responses to your scheduling inquiries
- Follow-up appointment scheduling
Important SMS Information:
- Message frequency varies based on your appointment activity
- Message and data rates may apply depending on your carrier and plan
- Supported carriers include all major US carriers
- SMS messages are not encrypted and may not be fully secure
Opt-Out Procedures
You may opt out of receiving text messages at any time using any of the following methods:
- Reply STOP to any text message from us
- Call our office at 956-476-5310 and request to be removed
- Email us at buckeyephysicaltherapy@gmail.com
After opting out, you will receive a final confirmation message. You will no longer receive text messages from us unless you text us again or explicitly opt back in by replying START.
Please note that opting out of text messages does not cancel any existing appointments. To cancel an appointment, please call our office.
Appointment Scheduling
Appointments scheduled through our SMS system are subject to the following conditions:
- Appointments are confirmed only after you receive a confirmation message
- Appointment availability is subject to change and is provided on a first-come, first-served basis
- We may need to reschedule appointments due to unforeseen circumstances
- Cancellations and rescheduling should be done at least 24 hours before your appointment when possible
HIPAA Compliance
All communications related to your healthcare are handled in compliance with the Health Insurance Portability and Accountability Act (HIPAA). We limit the information shared via text message to the minimum necessary for scheduling purposes, such as your name and appointment time.
Please be aware that SMS messages are transmitted over cellular networks and may not be fully encrypted. If you have concerns about the security of text-based communications, please contact us to arrange alternative scheduling methods.
No Guarantee of Message Delivery
While we make every effort to ensure timely delivery of text messages, we cannot guarantee that all messages will be delivered. Message delivery depends on your mobile carrier, network conditions, and device settings. It is your responsibility to confirm appointments if you do not receive a confirmation or reminder message.
Acceptable Use
When using our SMS scheduling service, you agree to:
- Provide accurate personal and contact information
- Use the service only for legitimate appointment scheduling purposes
- Not send abusive, threatening, or inappropriate messages
- Not attempt to interfere with or disrupt our scheduling system
Limitation of Liability
To the fullest extent permitted by law, Buckeye Physical Therapy shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our SMS scheduling service, including but not limited to:
- Failure or delay in message delivery
- Missed appointments due to undelivered reminders
- Errors in scheduling or appointment information
- Unauthorized access to messages on your device
- Service interruptions or technical issues
Our total liability for any claims related to the SMS scheduling service shall not exceed the amount of any fees paid by you for the specific service giving rise to the claim.
Disclaimer
Our SMS scheduling service is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the service will be uninterrupted, error-free, or completely secure.
The scheduling service is an administrative tool for appointment management and does not constitute medical advice. For medical emergencies, call 911.
Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the State of Texas, without regard to its conflict of law provisions. Any disputes arising from these terms or your use of our services shall be resolved in the courts of Hidalgo County, Texas.
Changes to These Terms
We reserve the right to update or modify these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after any changes are posted constitutes your acceptance of the revised terms.
